2. Eligibility: The GardenZeus LLC Spring 2018 Bonus Entry (“Promotion”) is open to legal residents of the California, U.S.A. 21 years of age and older at the time the promotion begins. An eligible entrant must provide to GardenZeus LLC (“Sponsor”) his or her name and email address. Employees, contractors and owners of Sponsor and their immediate family/household members are ineligible. Promotion is subject to applicable federal, state, provincial and local laws and regulations and void where prohibited or restricted by law or regulations. Promotion is not open to residents of any state except California, is not open to residents of Canada, Puerto Rico, U.S. Virgin Islands, and U.S. military installations located in foreign countries and outside the United States, and is not open to residents of any other location outside of the State of California.
3. Promotional Period: Promotion begins February 12, 2018 (12:01 AM PST) and ends April 9, 2018 (11:59 PM PST) (the “Promotional Period”). The computer clock of the Sponsor is the official time-keeping device in the Promotion.
4. Agreement to the Official Rules: By participating in the Promotion, entrant warrants that he or she (1) has read, understands and accepts these Official Rules and Sponsor’s Privacy Policy; (2) accepts and will comply with the decisions of the Sponsor in connection with this Promotion, which are final and binding; and (3) meets the eligibility requirements of this Promotion and is not otherwise prohibited from participating in the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth in these Official Rules.

Completed entries must be received by 11:59 PM PST on April 9, 2018. Entrants may enter only once during the entire Promotional Period and receive one point for entering; however, entrants receive additional points based on the following bonus actions:

Proof of email or online submission is not considered proof of delivery or receipt. All entries become the property of GardenZeus LLC.
7. Prizes, Number of Prizes, and Approximate Retail Value (“ARV”): There will be five (5) prizes awarded, with a total ARV of $191.50; more particularly, five (5) prizes with ARVs as follows: Wooden Garden Trug, ARV $89.00; $50 Gift Certificate to Heirloom Roses, ARV $50.00; and three sets of Botanical Interests Favorite Cut flower Collection, ARV of $17.50 each. Prizes are referred to severally as the Prize (the “Prize.”) Limit of one Prize per natural person. The odds of winning each Prize is the same.
Odds: Odds of winning depend on the number of eligible entries received and the points earned by each eligible entrant. The more bonus actions each entrant completes the greater the odds are that such entrant will win a Prize. Sponsor operated a similar contest in December, 2017 in which five prizes were awarded based on bonus actions. While one contest is not necessarily indicative of another contest and the December, 2017 contest was operated over a relatively short period of time, in the December, 2017 contest, the odds of winning any one of the five offered prizes were approximately 1 out of 17.
Prizes are not transferable: There shall be no substitutions or exchanges, including for cash, of any Prizes, except that Sponsor reserves the right to substitute a Prize of greater value. In the event any Prize becomes out of stock or otherwise unavailable before the Prizes are awarded, Sponsor reserves the right to substitute a gift certificate in an amount equal to or greater than the ARV of the original Prize. Postage for all Prizes delivered to the winners’ residential addresses in California will be paid for by Sponsor.
8. Tax Information: Winners are responsible for all federal, state and local taxes, if any, associated with acceptance or use of the Prize. Prizes are provided “as is” and without any warranty of any kind.
9. Winner Selection: Potential winners will be selected in five random drawings to be held on or about April 12, 2018, in Pasadena, CA, from among all entrants submitting entries during the Promotion Period. All results of the selections are final and binding and shall be in accordance with these Official Rules.
10. Notice to Winner: Sponsor shall attempt to notify each potential winner by email within five (5) days of the winners’ selection. If Sponsor is unable to make contact with any given winner within ten (10) days after Sponsor first attempts to notify the winner, or if the winner fails to claim the prize within ten (10) days after Sponsor first successfully notifies the winner, the Prize may be forfeited and awarded to an alternate winner.
If the potential winning entry is discovered to be invalid for any reason or if the potential winner fails to fully comply with these Official Rues, such entrant will forfeit that prize and an alternate winner will be selected from among all remaining entrants. Sponsor shall verify that each winner meets the eligibility requirements of the Promotion before such winner is awarded a prize. Prize winners will be required to sign and return an Affidavit of Eligibility and Agreement to Official Rules via email. Potential winners must claim their prize by completing, signing and returning all such required document within ten (10) days following Sponsor’s first successful notification or the Prize may be forfeited and an alternate winner selected.
If by reason of a printing, computer or other error, more prizes are claimed than the number set forth in these Official Rules, all persons making purportedly valid claims will be included in a computerized random selection to award the advertised number of Prizes available. No more than the advertised number of Prizes will be awarded.
11. General Conditions: Entries not in compliance with these Official Rules, including but not limited to those not meeting the eligibility requirements, are disqualified. Sponsor shall have the absolute right to determine if an entry is in compliance with these Official Rules without notice to the person attempting to enter. Sponsor reserves the right to cancel or modify the Promotion at any time without notice. Entries generated by an automatic means will be disqualified. Entries that are incomplete or corrupted will not be accepted. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of such provision.
In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the authorized account holder.
12. Use of Personal Information: Information collected for this Promotion is used only for the purpose of administering this Promotion and notifying the winners and will not be reused, sold or shared in any manner by Sponsor; provided, however, that Sponsor may use such personal information to send entrants information about itself, in a manner consistent with its Privacy Policy. Entrants will be provided with an opportunity to opt-out of receiving this information at any time after they first receive such information from Sponsor.
13. Not Endorsed by the maker or manufacturer of any Prize (the “Suppliers”). By participating in this Promotion, you acknowledge that this Promotion is in no way sponsored, endorsed, administered by, or associated with the Suppliers and hereby release the Suppliers from any and all liability arising from or related to this Promotion. The information you are providing in connection with this Promotion is being provided to Sponsor and not to any Suppliers.
14. Release: As a condition of participating in the Promotion, entrant agrees to release, hold harmless and indemnify the Sponsor from and against any and all liability, claims, damages, or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained, in whole or in part,, directly or indirectly, in connection with (1) participation in any aspect of the Promotion (2) the receipt, ownership or use of the Prize awarded, (3) entrant’s registration material on any related website (4) any typographical or other error in these Official Rules, (5) rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, whether under a theory of contract, tort (including negligence), warranty or other theory. In no event shall Sponsor be liable for attorney’s fees, or for costs related in any way to the use of any Prize.
15. Limitations of Liability: Sponsor assumes no responsibility or liability for (1) lost, late, stolen, undelivered, inaccurate, incomplete, delayed, misdirected, damaged or garbled entries, URLs, or emails: (2) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (3) any unauthorized access to, or theft, destruction or alternation of entries at any point during this Promotion; (4) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, cable, satellites, servers, computers or providers utilized in any respect in connection with the Promotion; (5) inaccessibility or unavailability of the internet, Sponsor’s website or any combination thereof or for computer hardware or software malfunctions, failures or difficulties, or other errors of difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties in connection with administering the Promotion, processing entries, social networking posts, registrations, notification of prizes, or in any other Promotion-related materials; (6) undeliverable emails resulting from any form of active or passive email filtering by an entrant’s internet service provider and/or email client or for insufficient space in entrant’s email account to receive email; and (7) any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the Promotion. If the Promotion is not capable of running as planned for any reason, including but not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or causes which may corrupt or affect the administration, security or integrity of this Promotion, then Sponsor reserves the right to cancel, modify or suspend the Promotion in whole or in part. If so cancelled, modified or suspended, Sponsor shall award the prize from among all non-suspect, eligible entries received for the Promotion up to the time of such action.
16. Choice of Law and Jurisdiction: Except where prohibited, each entrant agrees that any issues, questions, disputes, claims and causes of action arising out of, or in connection with, the Promotion shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the appropriate federal, state and local courts located in the State of California for any and all disputes, claims and causes of action arising out of or connected with this Promotion.
